Terms and Conditions for ListIN.my

Welcome to ListIN.my. These Terms and Conditions (“Terms”) govern your access to and use of the ListIN.my property listing platform (the “Platform”). By accessing or using ListIN.my, you agree to comply with these Terms. If you do not agree with any part of these Terms, please do not use the Platform.

1. General Terms of Use

1.1 Acceptance of Terms

By using ListIN.my, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (which is incorporated herein by reference). These Terms apply to all users of the Platform, including property owners, agents, and general visitors. If you are using the Platform on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

1.2 Eligibility

Use of the Platform is limited to individuals 18 years or older (or the age of legal majority in your jurisdiction). By registering or using ListIN.my, you represent that you meet this age requirement and that all information you submit is truthful and accurate. Accounts may not be created or used by bots or other automated methods. We reserve the right to suspend or terminate accounts that we suspect are in violation of these eligibility requirements.

1.3 Account Registration and Security

Some features of ListIN.my (such as posting property listings or contacting agents) require you to create an account. When creating an account, you agree to provide current, complete, and accurate information. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You must notify ListIN.my immediately of any unauthorized use of your account or any other breach of security. ListIN.my will not be liable for any loss or damage arising from your failure to keep your account information secure. You agree not to share your username and password with others or allow others to access the Platform through your account.

1.4 Acceptable Use

When using the Platform, you agree to adhere to the following acceptable use requirements:

  • Lawful Purposes: You will use ListIN.my only for lawful purposes and in accordance with these Terms. You must not use the Platform to violate any applicable local, state, national, or international law or regulation.
  • Respect for Others: You will not harass, abuse, defame, impersonate, or intimidate other users. Hate speech, discrimination, or content that is obscene, indecent, or offensive is strictly prohibited.
  • No Harmful Activities: You will not upload or transmit viruses, malware, or any other malicious code that could harm the Platform or other users. You agree not to interfere with or disrupt the proper functioning of the Platform (for example, by conducting denial-of-service attacks, spamming, or using automated scripts to collect information).
  • No Data Mining or Scraping: You shall not engage in “data mining,” scraping, crawling, or use any automated system to harvest data from the Platform without our prior written permission. The content and listings on ListIN.my are for personal use or legitimate real estate transactions only, and not for aggregation and display on other websites without authorization.
  • Accuracy of Interactions: If you choose to contact an agent or owner through the Platform, you will do so with honest intent (e.g., genuine inquiries about a property). You will not use contact information obtained from ListIN.my to send unsolicited marketing messages or spam.

Failure to comply with the above acceptable use rules constitutes a material breach of these Terms and may result in suspension or termination of your access (see Modifications & Termination below).

2. Listing and Agent Responsibilities

ListIN.my allows property owners and licensed agents (“Advertisers”) to post property listings. If you create a listing or otherwise advertise a property on the Platform, you agree to the following additional terms:

2.1 Authority to Post Listings

You represent and warrant that you are authorized to list the property in question. This means:

  • If you are a property owner, you have the legal right to sell or rent the property.
  • If you are a real estate agent or agency, you are properly licensed (as required by Malaysian law or other applicable laws) and have obtained the property owner’s consent or an agreement to list and market the property. You must adhere to all laws and regulations applicable to real estate agents, including any registration requirements and ethical standards.

2.2 Accuracy and Currency of Information

You are responsible for ensuring that all information in your listings is accurate, current, and not misleading. This includes, but is not limited to: the property type, location (address), price, size, features, photos, and any other relevant details. Misrepresentation or posting false information is strictly prohibited. You agree to promptly update or remove a listing if the property becomes unavailable or if any information changes (for example, if the property is sold, rented, or if the listing price changes). ListIN.my is not responsible for verifying the accuracy of user-submitted listings, so it is essential that you provide truthful information.

  • Remove Unavailable Listings: If a property is no longer available (sold, rented, off-market), you must remove the listing from the Platform in a timely manner. Keeping unavailable or outdated listings online can mislead users and is against these Terms.
  • One Property, One Listing: You should not post multiple duplicate listings for the same property. If you have already listed a property, do not create additional listings for it. Duplication can confuse users and degrade the quality of the Platform.

2.3 Content Quality and Restrictions

All content you post as part of a property listing (including descriptions, photographs, videos, floor plans, etc.) must be appropriate and owned by you (or you must have the legal right to use it). You agree that:

  • Photographs and Media: You will upload clear images (and optional videos) that accurately depict the property. Do not use stock images or photographs of a different property. Watermarks or branding on images should be minimal and not obscure the property. Ensure any video content focuses on the property itself.
  • No Infringement: Your listing content must not infringe the intellectual property rights or privacy rights of any third party. You must either own the copyright in the content (e.g., you took the photos) or have permission from the rights-holder (for example, using developer-provided images with their consent). Do not upload content taken from other websites or listings without authorization.
  • Prohibited Content: Listings must be for real, available properties. You may not post listings that are fraudulent or involve illegal properties. Additionally, your listing description and media must not include anything defamatory, obscene, discriminatory (such as race-based or religion-based exclusions for tenants or buyers), or otherwise illegal. Personal data that is not necessary for the property advertisement (such as a homeowner’s personal contact details or NRIC number) should not be included in the public listing description to protect privacy. ListIN.my reserves the right to edit or remove any content that violates these guidelines or that we find objectionable for any reason.

2.4 Listing Ownership and License to ListIN.my

You retain ownership of the content (text, images, etc.) you post in your property listings. However, by posting content on ListIN.my, you grant ListIN.my a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate, distribute, and display this content on the Platform and related marketing materials. This license is solely for the purposes of operating and promoting the Platform (for example, displaying your listing to interested buyers/renters, or featuring your listing in promotional emails). ListIN.my will never claim ownership of your images or descriptions, but we may retain archived copies of your content for a period even after a listing is removed, as part of our backup systems or as required by law.

2.5 Agent and Advertiser Conduct

If you are an agent or agency using ListIN.my, you agree to conduct yourself professionally and ethically. This includes responding to inquiries in a timely manner, not misusing leads’ personal information (any contact details you receive through the Platform should only be used to respond to the specific property inquiry), and abiding by all applicable real estate advertising standards. You are solely responsible for your interactions with prospective buyers or tenants. Any agreement or transaction arising from a listing on ListIN.my is strictly between you and the other party (buyer, seller, tenant, or landlord). ListIN.my is not a party to any sale, rental, or agreement facilitated through the Platform, and does not act as a broker or agent on behalf of any user.

3. Data Protection and GDPR Compliance

We take your privacy and data security seriously. ListIN.my does not leak, sell, or disclose personal data to third parties for their marketing or any other purposes without your explicit consent. Our data practices are designed to comply with Malaysia’s data protection laws and the European Union’s General Data Protection Regulation (GDPR) where applicable. By using the Platform, you acknowledge and consent to the collection and use of your data as outlined in these Terms and our Privacy Policy, in compliance with these regulations.

3.1 Personal Data Collection and Use

When you use ListIN.my (for example, when you create an account or post a listing, or send an inquiry), we may collect certain personal information from you such as your name, contact information (email address, phone number), and any details you provide about your property or search criteria. This information is used solely for the purpose of providing and improving our services, such as:

  • Creating and managing your user account.
  • Facilitating communications between property seekers and advertisers (for instance, if a user is interested in your property listing, the Platform may share the contact information you have provided with that user, and vice versa, but only as needed to connect buyers and sellers or tenants and landlords).
  • Sending you service-related announcements or communications. We may also send promotional communications or newsletters, but you will have the option to opt-out of such marketing messages.

We will never sell your personal information to third-party marketers. We do not disclose your personal data to third parties unless it is necessary to deliver our service (for example, using an email service provider to send messages on our behalf, who will be bound to protect your data), or if required by law (such as a lawful request by public authorities).

3.2 Security Measures

ListIN.my employs robust security measures to safeguard your personal data. We utilize decentralized data storage and hashing/encryption techniques for sensitive information:

  • Decentralized Data Storage: Rather than storing all user data in a single database or location, we distribute and store data across secure servers and systems. This approach reduces the risk of a single point of failure and helps protect against large-scale data breaches. In practice, this means your data is compartmentalized and access is strictly controlled on a need-to-know basis.
  • Hash Protection & Encryption: Sensitive personal data fields (for example, account passwords, property owner contact details, and specific unit numbers or addresses that are not meant to be public) are stored in hashed or encrypted form. Hashing is a one-way process that scrambles data into a form that cannot be easily understood without the correct key. Encryption ensures that if any unauthorized party were to access our data storage, the information would be unreadable and secure.

While we implement industry-standard security practices and continually update our safeguards, no system can be 100% secure. By using the Platform, you acknowledge that you understand these risks. In the unlikely event of a data breach, we will follow all applicable laws in notifying users and authorities, and we will take immediate steps to mitigate the breach and prevent future occurrences.

3.3 User Data Rights

ListIN.my respects your rights regarding your personal data. In line with the Malaysian Personal Data Protection Act 2010 (PDPA) and the GDPR, you have the following rights (depending on your jurisdiction and applicability of law):

  • Access and Correction: You may request a copy of the personal data we hold about you, and you have the right to correct or update any inaccuracies in your personal data. Most of this can be done directly through your account settings, but you can also contact us for assistance.
  • Deletion (Right to be Forgotten): You may request that we delete your personal data. We will honor such requests to the extent required by applicable law. Note that we may need to retain certain information for legal or administrative purposes (for example, records of transactions or communications).
  • Data Portability: For users under GDPR jurisdiction, you have the right to request a portable copy of the data you have provided to us in a commonly used format.
  • Objection and Restriction: You can object to certain data processing (such as direct marketing), or request that we restrict processing in certain circumstances. For example, you can opt out of marketing emails at any time by using the unsubscribe link or contacting us.

To exercise any of these rights or for any privacy-related inquiries, please reach out to us using the contact information in the Contact Information section below. We will respond to legitimate requests within the timeframe required by law (e.g., within 30 days for GDPR requests) and will not discriminate against you for exercising any of these rights.

3.4 No Unauthorized Disclosure

Except as provided in these Terms or our Privacy Policy, we will not disclose your personal data to any third party without your consent. ListIN.my may share data with service providers that help us run the Platform (such as cloud hosting providers or email delivery services), but in all such cases, those service providers are contractually obligated to keep your information confidential and to use it only for the specific services we request. We do not engage in selling mailing lists or revealing user information to external parties for their own uses. Your trust is important to us, and maintaining the confidentiality of your personal information is a top priority.

4. Intellectual Property Rights

4.1 Platform Content

All content and materials available on ListIN.my (excluding user-generated listings), including but not limited to the website design, text, graphics, logos, trademarks, button icons, images, software, and overall look-and-feel of the Platform, are the intellectual property of ListIN.my or its content suppliers and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, distribute, or create derivative works from any portions of the Platform content unless expressly authorized by ListIN.my. Unauthorized use of the Platform’s intellectual property is strictly prohibited.

  • The name “ListIN.my”, our logos, and any slogans or taglines are trademarks/service marks owned by us. You may not use these marks in any way (including meta tags or advertising) without our prior written consent.
  • Any third-party trademarks or logos appearing on ListIN.my (for example, agency logos, developer logos, or partner logos) are the property of their respective owners. Their appearance on the Platform does not imply endorsement or permission by those owners for you to use them. You must not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices integrated into the Platform.

4.2 User-Generated Content (Listings)

As noted in Section 2.4, users (agents or owners) retain ownership of the content they post in listings. However, by submitting content to the Platform, you confirm that you have the right to do so and you grant ListIN.my the license to use it as described above. You also agree that we may display advertising and other information adjacent to or included with your listing content (for example, we might show ads on a page where your listing appears, or show your listing in search results alongside others). You are not entitled to any compensation for such advertisements. We do not claim ownership of your content, but you are responsible for ensuring that you have the rights needed to post it. If you submit any content (like text or photos), you warrant that:

  • The content is your original work or you have obtained all necessary rights, licenses, or permissions to use it on our Platform.
  • The content does not violate any copyright, trademark, trade secret, or other intellectual property rights of any person or entity.
  • The content does not contain confidential information or trade secrets of a third party, unless you have permission to disclose such information.

ListIN.my may, at its discretion, remove or disable access to any user content that is alleged to infringe on another’s intellectual property rights or that is otherwise in violation of these Terms. If you believe content on the Platform infringes your copyright or other IP rights, please notify us with details so we can investigate and take appropriate action (see Contact Information for how to reach us).

4.3 Limited License to Users

ListIN.my grants you a limited, revocable, non-exclusive, and non-transferable license to access and use the Platform for your personal use (if you are a property seeker) or for your legitimate business of listing properties (if you are an agent or owner), in accordance with these Terms. This license does not allow you to resell or commercially exploit any portion of the Platform, to collect or use listings, descriptions, or other content for the benefit of any third party (except in the normal use of buying, selling, or renting properties), or to use any data mining or extraction tools as noted in Section 1.4. All rights not expressly granted to you in these Terms are reserved by ListIN.my.

5. Disclaimers

5.1 Third-Party Listings and Content

Much of the content on ListIN.my is provided by third-party users (agents, owners, advertisers). ListIN.my is a platform and is not the creator or publisher of those property listings. As such, we do not guarantee the accuracy, completeness, or quality of the information in those listings. Property descriptions, availability, pricing, and other details are the sole responsibility of the user who posted the listing. While we may, at our discretion, perform limited checks or moderation of content (for example, removing listings that have been reported or appear to violate our policies), we do not actively verify all information provided in listings.

Use caution and due diligence when relying on information from listings. If you are interested in a property, it is your responsibility to verify important details (such as condition of the property, legal ownership, terms of sale/lease, etc.) with the advertiser or through appropriate legal or professional channels. Any arrangements (such as property viewings, transactions, payments, or agreements) that you enter into with a property owner or agent found on ListIN.my are made at your own risk and are strictly between you and the other party. ListIN.my is not a real estate broker or agency, and we do not participate in any contracts or transactions between users.

Additionally, ListIN.my may contain links or references to third-party websites (for example, a link to an external loan calculator, or an agent’s personal webpage). These links are provided for convenience only. We have no control over third-party sites and accept no responsibility for their content, policies, or practices. Accessing any third-party site via our Platform is done at your own risk, and you should review the terms and privacy policies of any site you visit.

5.2 No Warranty on Platform Services

The Platform and all content, information, and services provided on or through it are provided on an “as is” and “as available” basis, without any warranties of any kind. To the fullest extent permissible under applicable law, ListIN.my disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Platform will meet your requirements or expectations, or that access to the Platform will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy or completeness of any information on the Platform (including, but not limited to, listings), nor do we warrant that any defects or errors will be corrected.

No advice or information (whether oral or written) obtained by you from ListIN.my or through the Platform shall create any warranty not expressly stated in these Terms.

5.3 Technical Disclaimers

While we strive to maintain the performance and availability of ListIN.my, we cannot guarantee that the Platform will always function without disruptions, delays, or imperfections. Downtime, data loss, or technical issues may occur, and you agree that ListIN.my is not liable for such issues. You are responsible for taking your own precautions to ensure the compatibility of your device and secure backup of any data (for example, keeping backup copies of important messages or information you obtain via the Platform).

ListIN.my also does not guarantee that the Platform will be free from viruses or other harmful components. You should use up-to-date antivirus software on your devices. Any material downloaded or otherwise obtained through the use of the Platform is done at your own discretion and risk.

6. Limitation of Liability

6.1 Indirect Damages

To the maximum extent permitted by law, ListIN.my and its parent company, affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages whatsoever. This includes, without limitation, damages for loss of profits, loss of data, loss of goodwill, business interruption, or other intangible losses arising out of or related to your use of (or inability to use) the Platform, even if we have been advised of the possibility of such damages.

6.2 Direct Damages Cap

To the extent that we are found liable for any claim arising out of or related to your use of the Platform, our aggregate liability to you for any and all claims in a given calendar year will not exceed the total amount of fees (if any) you paid to ListIN.my for use of the Platform in that year. If you have not paid any fees (for example, if you use only free services), our liability will be zero in such cases. Some jurisdictions do not allow the limitation of liability in certain cases, so the above limitation may not apply to you in those jurisdictions. In any case, our liability will be limited to the greatest extent permitted by law.

6.3 Specific Situations

Without limiting the generality of the foregoing, ListIN.my and related parties shall not be liable for any claims, losses, or damages resulting from:

  • Errors or Omissions in Listings: Any mistakes or missing information in property listings or other user-provided content. The responsibility for listings lies with the posting user, and you acknowledge this risk.
  • Transactions or Deals: Any property sale, purchase, rental, lease, or other transaction initiated because of a listing on ListIN.my. We do not vet or guarantee any party’s performance on agreements. Any contract is solely between the buyer and seller (or landlord and tenant, etc.). If a deal falls through or there are legal issues, you agree that ListIN.my is not responsible.
  • Unauthorized Access: Unauthorized access to or use of our servers and/or any personal information stored therein, except to the extent that applicable law prohibits such exclusions. (We implement strong security measures as noted in Section 3.2, but cannot warrant absolute security.)
  • Force Majeure: Any events beyond our reasonable control, such as internet outages, network failures, acts of God, war, terrorism, civil disturbances, strikes, pandemics, or governmental actions that may disrupt the Platform’s availability or performance.

By using ListIN.my, you agree that your sole remedy for dissatisfaction with the Platform or any content is to stop using the Platform. If you are dissatisfied with any aspect of our service, please contact us and we will try to address your concerns, but we do not guarantee any remedy.

6.4 Indemnification

(Note: Indemnification means you agree to compensate us for losses if your actions cause us to be sued or incur costs.) You agree to indemnify, defend, and hold harmless ListIN.my and its affiliates, officers, agents, partners, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) that arise from or relate to your use or misuse of the Platform, your violation of these Terms, your violation of any rights of a third party (for example, intellectual property or privacy rights), or your breach of any representation or warranty in these Terms. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with our defense of such claim). This indemnity obligation will survive the termination of your relationship with ListIN.my and the use of the Platform.

7. Modifications and Termination

7.1 Changes to Terms and Platform

ListIN.my reserves the right to modify these Terms at any time. If we make material changes, we will notify users by posting the updated Terms on our website and updating the “Last Updated” date at the top, or through other appropriate communication channels. It is your responsibility to review these Terms periodically for updates. Your continued use of the Platform after any modifications to the Terms constitutes acceptance of those changes. If you do not agree with a change, you must stop using the Platform and (if applicable) cancel your account.

Similarly, ListIN.my may update, change, or discontinue any aspect of the Platform at any time. This could include adding or removing features, changing the look and feel, instituting or changing fees for certain services, or discontinuing certain services entirely. We will endeavor to give advance notice for major changes when feasible, but we are not obligated to maintain any particular aspect of the Platform for any minimum period.

7.2 Suspension or Termination by ListIN.my

We may suspend or terminate your account or access to the Platform immediately, without prior notice or liability, if we in our sole discretion determine that you have violated these Terms or if we suspect fraudulent, abusive, or unlawful activity that may affect the Platform or its users. We may also suspend or terminate accounts that are inactive for an extended period, or for any other reason as deemed necessary to protect our interests or those of our users. In the event of termination due to a breach of these Terms, you are not entitled to any refund of fees (if any were paid by you).

Termination of your access may involve removal of your account and deletion of any content you uploaded. However, certain data may be retained as needed for legal compliance or legitimate business purposes (for example, logs or records of transactions may be kept). We also reserve the right to remove or modify any listings or content that violate our guidelines, without necessarily terminating the associated account (for example, we might just remove an offending listing and warn the user).

7.3 Termination by You

You have the right to terminate your account at any time if you no longer wish to use our services. You can do so by contacting ListIN.my support (see Contact Information below) or, if available, by using an account deletion or deactivation feature on the Platform. Upon your request, we will deactivate or delete your account, and you will no longer be able to log in. Keep in mind that content you have posted (such as property listings, comments, or messages) may still be retained or displayed on the Platform even after your account is deleted, at least for some time, especially if you had active listings that were viewed or cached by others. We will handle personal data in accordance with our data retention policies and applicable law (see Section 3.3 on Data Rights and deletion).

7.4 Survival of Terms

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: ownership provisions (Intellectual Property rights), disclaimers of warranties, limitations of liability, indemnity, and governing law. Termination of your access or account does not relieve you of any obligations or liability accrued prior to the termination effective date.

8. Governing Law and Jurisdiction

These Terms and Conditions, and any disputes arising out of or related to the Platform, shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of ListIN.my shall be brought exclusively in the courts of Malaysia. You consent to the jurisdiction of and venue in such courts, and waive any objection that such courts represent an inconvenient forum. However, we reserve the right to seek injunctive or equitable relief in any jurisdiction if necessary to protect our interests or enforce any right or obligation under these Terms (for example, to protect our intellectual property rights).

If you are accessing or using the Platform from a jurisdiction outside Malaysia, you do so at your own risk and are responsible for compliance with the laws of that jurisdiction, to the extent those laws apply. Please be aware that your personal data may be transferred to, stored, and processed in Malaysia (and possibly other jurisdictions where our servers or facilities are located). By using the Platform, you consent to such transfer and processing of data in accordance with our Privacy Policy and Section 3 above.

Acknowledgment: By using ListIN.my, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them. These Terms, together with our Privacy Policy and any other legal notices or guidelines published by ListIN.my on the Platform, constitute the entire agreement between you and ListIN.my concerning your use of the Platform. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.
